Penal code
Every crime in the city with its class, its fine, its jail minutes at Bolingbroke, whether it goes to trial and whether it can cost the gun licence. The police sentence by this table, never more (rule 6.2.4), and the general rules are in section 8 of the rulebook. Changes are approved by the Gobernación (rule 6.4.1).
Five new charges since 28 September.
- TRA-06 · Driving under the influence of alcohol or drugs: $2,500 and 10 min, class B.
- TRA-07 · Parking in a prohibited place or abandoning a vehicle: $500, class C.
- ORD-09 · Refusing to identify yourself to an officer: $1,000, class C.
- ORD-10 · Covering your face during a crime: $1,500, class C.
- ROB-08 · Carrying burglary tools during an attempt or next to the target: $1,000, class C.
Chapter 01
The three classes
Every crime has a class, and the class decides who sets the penalty (rule 8.1).
- C Minor: fine only
- The officer charges it on the spot with an invoice through F6. No jail. If you disagree, you may ask for a trial. There are 14 class C crimes.
- B Less serious: fine and jail
- The police sentence, adding up fine and minutes. The detainee may ask for a trial, and at trial the penalty can go up or down. For the weapons crimes that remove the licence, trial is mandatory if the accused holds a gun licence (rule 8.4). There are 19 class B crimes.
- A Serious: mandatory trial
- The police may apply up to 20 minutes of pre-trial detention and open the case in #case-files-casos; the final sentence comes from the judge (rule 8.3). The fine and minutes in the table are the judge's reference. There are 11 class A crimes.
Chapter 02
How a sentence is worked out
- Charges add up. Every charge in a single arrest adds up, with a cap on the police sentence of 60 minutes of jail and $100,000. See rule 8.2
- Trial within 48 hours. If you ask for a trial and nobody takes it within 48 real hours, half the police sentence stands; for class A, half the penalty in the table. See rule 6.4.4
- Cooperating. The prosecutor may offer up to half the sentence in exchange for cooperation. See rule 8.5
- Gun licence. Always removed by a judge, never by an officer on the street. The last column shows which crimes can remove it. See rule 8.4
- Aggravating factor. Covering your face (ORD-10) is never charged alone: it is added to another charge.
- Fines. Charged by invoice. If the total is over $50,000, it is split into the invoices that limit requires. Unpaid: 3 days' grace, then 5% more every 24 hours, up to double. See rule 6.1.10
- Jail. Served at Bolingbroke. On the way in, the system confiscates drugs, supplies, spray and every weapon and all ammo, legal ones included.
Example. Fleeing in a pursuit (TRA-05), resisting arrest (ORD-06) and a legal weapon without a licence (ARM-01): $5,000 + $2,500 + $4,000 = $11,500, and 15 + 10 + 10 = 35 minutes. All class B: the police sentence, and the detainee may ask for a trial.
